Q1: What discussions led up to the creation of this act?
A1: Several discussions with our constituents led to the creation of this act. The people of Newton County MO began asking us to ensure their rights as soon as they realized that the Biden administration was going to be looking at gun control measures. Those concerned citizens asked what we as the Newton County Commission could do to protect their 2nd Amendment Rights. Concerns have also been voiced that the current administration wants total control of the US population. They believe the next logical step would be to disarm law-abiding citizens who would stand in the way of their plan. No matter where on the spectrum this line of thinking falls, I still felt that it was important to protect the rights granted in our constitution.
Q2: One of the clauses allows for local law enforcement to arrest federal officers if they attempt to violate the clause of the act. Where did the idea and language for this clause come from?
A2: This language came from a collaborative effort between commissioners and constituents. Of course, we also consulted with legal counsel.
Q3: Was it a unanimous vote to pass it?
A3: Absolutely. After a great deal of consideration and thorough read throughs by each Commissioner, we passed the ordinance with a unanimous roll call vote on February 3rd, 2021.
Q4: How do you see this working in practicality?
A4: This ordinance is meant to be an extra layer of Protection from federal overreach. We see it as a way to start the conversation about the legality and reasons as to why federal agents or agencies would need to violate law-abiding citizens 2nd Amendment Rights.
Q5: Are any instances known in which this has already occurred, or can you point to a past incident that prompted the inclusion of this clause?
A5: No, and I pray we never will. However, we are prepared to use all legal means to enforce it.
Q6: Are there concerns about whether the legislation is actually enforceable?
A6: No, we believe it to be fully enforceable to the extent that we have given full authority to the Sheriff of Newton County MO to enforce it. It is important to note that the Sheriff of any county in Missouri has always had full authority to protect the law-abiding residents of their counties from any threats from anyone person or organization or administration.
Q7: If an agent is arrested what would be the specific crime they would be charged with?
A7: That would depend on how they violate the county ordinance. I am confident our sheriff would respond appropriately as would our prosecuting Attorney.

A8: Everything we have seen at the County level has been positive. In fact, many other counties from outside of Missouri have also been supportive and even asked for us to help them adopt similar ordinances.
